API Terms of Service.

These terms explain the deal when you use an Apitalks API — what you can count on from us, and what we ask of you in return. We've kept them short and in plain English.

1. Who we are and what this covers

Apitalks s.r.o. provides data APIs. Our company details are in the imprint.

These terms cover every Apitalks data API you use — we'll call it "the Service". What each API contains, what its limits are, and what it costs live in that API's documentation and on our pricing page. Those pages are part of these terms.

2. Free and paid APIs

Some of our APIs (and some tiers) are free; others are paid. You'll always see which is which on the pricing page and in each API's docs.

• Free access is offered at no charge and "as is". We can change, limit, or switch it off whenever we need to, and the parts of these terms about fees, billing, and refunds simply don't apply to it.
• Paid access adds the promises about pricing, billing, cancelling, and ending access in the sections below.

Everything else here — keeping your key safe, fair use, how accurate the data is, and so on — applies to both.

3. Free trials

Sometimes we offer a free trial of a paid API. Unless we say otherwise, a trial runs 30 days, costs nothing, and needs no payment details. Either of us can stop a trial at any time, and we don't make availability promises during one.

4. Your account and API key

You get one API key per customer unless we agree otherwise. Please keep it secret — anything done with your key is treated as done by you.

If your key leaks or is used without your permission, tell us at info@apitalks.com and we'll help, including swapping it for a new one.

5. Fair use

Please stay within the rate and usage limits shown for your plan and API (free APIs usually have tighter limits than paid ones).

Beyond that, just don't do the obviously unfriendly things: don't try to dodge the limits, take the Service apart, overload it, break the law with it, or get in the way of other customers.

6. Prices, payment, and tax (paid plans)

Paid plans renew automatically until you cancel. The exact price and limits are on the pricing page or in your order, and payment runs through Stripe.

All prices are in euro (EUR), net of and exclusive of VAT. If you are a business registered for VAT in an EU member state other than Czechia, VAT is reverse-charged: we invoice without VAT and you account for it yourself in your country.

7. Cancelling and refunds (paid plans)

You can cancel anytime from your account. Your plan stays active until the end of the period you have paid for, then stops. Monthly fees already paid are not refunded. For annual plans, we refund the unused whole months. We never charge you for a new period after you cancel.

Free access has nothing to cancel — you can simply stop using it, and so can we.

8. Data quality and source limits

For paid access, we use reasonable care to collect, process, and make available the data described in the relevant API documentation. The documentation may specify the sources, update cadence, and known limits for that API. If you report a material data error, we will investigate it and, where the issue is within our control, correct it or explain the source limitation.

Some data comes from official, public, or third-party sources. Those sources can be delayed, incomplete, changed, unavailable, or wrong. We do not guarantee that the data is error-free, complete, current at every moment, or suitable for every possible use.

The Service provides data and technical access to data. It is not legal, tax, customs, financial, regulatory, or other professional advice. You remain responsible for decisions, filings, declarations, payments, and compliance actions you make using the data.

9. Keeping the Service running

For paid plans, we use commercially reasonable efforts to keep the Service available. We don't promise a specific uptime percentage unless we agree one with you in writing. Free access is provided on a best-effort basis, with no availability promise at all.

Support is by email. Any target response times apply only if your plan states them or we've agreed them with you.

10. Using the results, and what stays ours

The APIs, the datasets we put together and their format, and our documentation are ours.

What you can do: use the results freely in your own business — show individual results to your own customers and advisers, and use them in your own quotes, documents, and products. That's what the Service is for.

What we ask you not to do: don't resell or hand others access to the Service as a stand-in for their own subscription, don't share your API key, and don't systematically copy large parts of the data we've compiled to build a competing or redistributable dataset. Want to redistribute at scale, or build a product on top of us? Talk to us — we're happy to set up a plan for that.

Much of the underlying information comes from open, public sources, and you're always free to get that from the source yourself. This section is about our Service and the data we've compiled — not about locking up public information.

11. If something goes wrong

Except for the express commitments in these terms and in the documentation for your paid plan, we do not give implied warranties.

To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect or knock-on losses, or for lost profit, data, or goodwill. For free access, where you've paid nothing, this means our liability is limited to the fullest extent the law allows.

12. Pausing or ending access

For paid access, we may suspend or end it if you don't pay, break the fair-use rules, create a security or legal risk, or use the Service in a way that harms other customers. Otherwise, paid access runs to the end of the period you've paid for.

Free access we can change, pause, or end at any time.

You can stop using the Service whenever you like. Cancelling and refunds are covered in section 7.

13. Changes to these terms

We may update these terms now and then. If a change matters, we'll give it a new version and let you know by email or another reasonable channel. If you keep using the Service after a change takes effect, that means you're okay with the update.

14. Which law applies

These terms are governed by the laws of the Czech Republic, and any dispute will be resolved by the courts of Prague.
